Retired General Rafael Percival Pena is in custody in the Palace of Justice in Santo Domingo, accused of the attempted murder of Higher Electoral Court Judge Jose Manuel Hernandez Peguero.
Percival Pena was arrested yesterday, Monday 19 January 2015, and was taken to the holding cells on the fourth floor. It is not yet known if he will be jailed on remand or questioned.
His arrest comes several weeks after Hernandez Peguero issued a complaint against him, alleging that he assaulted him in a hardware store in a mall. Percival Pena said it was the other way round and the judge had assaulted him.
The former National District prosecutor said that the former officer has assaulted him on two occasions, and that this can be corroborated by video footage from security cameras at the mall where the alleged incident took place, as well as by witness statements from the store’s security staff.
