Affiliates transferred illegally can choose ARS

After confirming the fraudulent transfer of members to the Family Health Insurance (SFS) Contributive Regimen who were transferred from the Health Risk Administrator (ARS) without their consent, the Superintendence of Health and Labor Risks (Sisalril) has announced that the affected individuals are free to choose the entity of their preference, by following a procedure that the Social Security Treasury (TSS) will establish for this purpose.

In a letter addressed to all of the ARS and to the associations that they represent, the superintendent, Fernando Caamano, explained that the violation of the affiliates’ rights came about when their affiliation was registered in the Single Information and Collection System without their express consent and without having signed the membership form approved by the entity.

The letter says that despite the repeated fines imposed by Sisalril for this violation, the practice persists, so Sisalril will proceed to reverse the affiliations to the ARS that are elected by the employees. The letter states that the regulatory entity will return all the per-capita payments that the ARS had received in defect in order to register them with the companies chosen by the members who were victims of the fraud.
