A National District court has denied bail to a Canadian businessman, Antonio Carbone, who is accused of the attempted murder last December of the head of operations of Dream Casinos, Fernando Baez Guerrero.
Carbone had appealed on the basis of habeas corpus saying that putting him in prison was both arbitrary and irrational, but his appeal was rejected by Judge Teofilo Andujar who confirmed the pre-trial custody term of one year in jail as handed down by National District Judge Margarita Cristo Cristo.
This is the third time that Carbone has appealed at being held on remand in jail and the third time the appeal has failed.
Andres Kan and Francesco Carbone have also been accused of the murder but they are on the run with an arrest warrant out for them.
Carbone was arrested in 25 January 2015 and charged with the attempted murder of the casino head of operations Fernando Baez.
The Carbone brothers have been embroiled in a series of lawsuits with wealthy Canadian philanthropist Michael DeGroote, who lent the pair CAN$112 million to purchase and operate casinos in the Dominican Republic.
In papers filed in Ontario Superior Court, DeGroote claims the Carbone brothers defrauded him for CAN$107.3 million, or 96%, of the original loan. In a counter-suit, the Carbones describe DeGroote as a predatory lender and allege he had mafia ties and was involved in death threats, influence peddling and murder conspiracies.
