Diario Libre reports on statements by lawyer Angel Lockward who is contesting the legality of a decision by the Superior Administrative Tribunal (TSA) to override a constitutional mandate that establishes that the number of deputies should be proportional to the population. The TSA ordered the number of deputies to be maintained at the same level as in the 2012 election, and the Central Electoral Board (JCE) has accepted this ruling, despite the fact that it violates the Constitution.
Lockward also points out that judge Delfina de Leon was not qualified to order that an article of the constitution not be applied. Furthermore, he says that the ruling was signed by judge Delfina de Leon despite the fact that she was not present during the process because she was on vacation. The process was heard by judge Federico Fernandez, which he cites as another irregularity in the process.
Lockward says that this means that the TSA ruling is null, first because it suspends an article of the Constitution, and second because a judge has violated legal principles. He says this order could end up being suspended by the Constitutional Tribunal.
In other words, if contested this could affect the legality of the vote outcome in the 15 May 2016 election.
