In a development on Monday 13 June 2016, the judge of the Third Court of Instruction of the National District, Danilo Amado Quevedo, declared his incompetence to review the pre-trial custody order issued against Blas Peralta and three others accused in the murder of Mateo Aquino Febrillet. The court had been instructed to hear the case by judge Jose Alejandro Vargas. The accused are serving pre-trial custody in the Centro de Correccion y Rehabilitacion in La Romana.
El Dia, nevertheless, reports that on the same day, the Sixth Instruction Court of the National District was instructed to hear the preliminary case against Blas Peralta and others.
The National District Public Prosecutor’s office had asked for the trial to begin against Blas Peralta, Rafael Herrera Pena, Gerardo Felix Bautista Mena and Franklin Alejandro Venegas Rivas, who are accused of the murder of the former rector of the Autonomous University of Santo Domingo (UASD), Mateo Aquino Febrillet.
Investigative Prosecutor Kelvyn Colon has established in writing that Blas Peralta Peralta is accused of being the driving force behind the murder of Aquino Febrillet and also the attempted murder of victims Eduar Andres Montas Lorenzo, Rosa Elaine Manana Fernandez, Omar Enriquillo Sosa Mendez and Joel Antonio Soriano Ramirez.
Gerardo Felix Bautista Mena, Franklin Alejandro Venegas Rivas and Rafael Herrera Pena are accused of being accessories to the murder of the former rector and accessories to the attempted murder of the other victims.
According to the prosecution service the crime took place on 11 March 2016 on Anacaona Avenue in Mirador Sur in Santo Domingo, when Blas Peralta along with Franklin Alejandro Venegas Rivas and Gerardo Felix Bautista Mena, used a firearm to shoot and kill Aquino Febrillet and tried to murder Eduar Andres Montas Lorenzo, Rosa Elaine Manana Fernandez, Omar Enriquillo Sosa Mendez and Joel Antonio Soriano Ramirez.
The events took place following a luncheon at a local restaurant where Mateo Aquino Febrillet had helped to break up an argument between Blas Peralta and Eduar Montas Lorenzo. Mateo Aquino then left together with his driver Joel Antonio Soriano Ramirez, his bodyguard, Omar Enriquillo Sosa Mendez and his secretary, Rosa Elaine Manana Fernandez. They were followed out by Montas Lorenzo who confirmed that the argument between him and Peralta had continued. They then all climbed into Aquino Febrillet’s vehicle and left.
They were then followed by the accused men and subsequently shots were fired at Aquino Febrillet’s vehicle and he was killed, and Rosa Elaine Manana Fernandez and Eduar Montas Lorenzo were injured.
