The Superior Administrative Court (TSA) has ruled in favor of the city government of San Pedro de Macorís. The Procurement Agency (DGCP) had revoked a tender that awarded a major garbage collection contract to a company owned by MLB baseball player Robinson Canó after citing major irregularities in the contracting.
The TSA instead has ruled in favor of the Mayor’s Office of San Pedro de Macoris. The San Pedro city government had sought the revoking of Procurement Agency Resolution RIC-85-2021 that had annulled on 27 April 2021, the tender whereby the company RJC CLEAR SRL had been awarded the collection of solid wastes in San Pedro de Macoris.
The decision is in the ruling No. 0030-01-2021-SSMC-00122 dated 23 July 2021.
In a separate case, now the Ministry of Education seeks to be favored by a similar decision from the TSA. It is asking the TSA to revoke another Procurement Agency resolution that declares there were major irregularities in a RD$10 billion emergency procurement for laptops, netbooks and tablets for public school students.
Earlier, the TSA had revoked a decision of the Central Electoral Board (JCE) that had declared only the Modern Revolutionary Party (PRM) and the Dominican Liberation Party (PLD) had majority party status as these were the only parties that met the requirement of 5% of the vote. The TSA ordered the funds be delivered to the Dominican Revolutionary Party (PRD) and the People’s Force (FP), arguing a little known clause of favorability.
