
The Dominican Republic obtained a favorable decision in the lawsuit filed against it by the Spanish company Recalvi SL. The company sought payment appealing to the Bilateral Investment Treaty subscribed between Spain and the Dominican Republic
Recalvi had accused the government bus company, Oficina Metropolitana de Servicios de Autobuses (Omsa) of violating contractual agreements regarding the leasing of buses.
Recalvi had filed an arbitration claim for US$14 million against OMSA in 2018 for the non-execution of the contract it had won in 2011 for the supply of 150 buses to the OMSA. The contract was not implemented after a change in government.
On 20 September 2021, the Arbitral Tribunal of Spain accepted the objections presented by the Dominican state lawyers and pointed to an abuse of procedure by the Spanish company. The court ordered Recalvi to pay US$789,633.70 in favor of the Dominican Republic to cover the legal proceedings.
