Businesses need to request ID or secret code to accept pay by debit card

The Supreme Court of Justice has ruled (Ruling # 2270-2021) that businesses need to request that their customers paying with debit cards show proof of identity or enter a secret code. The requirement is a measure that should be taken to prevent the improper use of the card. The ruling was issued by the First Chamber of the Supreme Court of Justice on 31 August 2021.

The objective is to generate an exercise of good practice by commercial establishments, to protect the user of a banking product from possible improper action by a third party that could be manifestly harmful to the cardholder.

The Supreme Court made the announcement on 18 October 2021.

After the pandemic, most businesses use automatic debit and credit card readers that do not require signature or have been requesting identification.
