
The legal recourse that seeks the provisional suspension of Ministry of Public Health Resolution #000048, which requires the presentation of a vaccination card against Covid-19 to enter closed public and private places in effect since 18 October, is ready for ruling at the Superior Administrative Court (TSA).
The presiding judge is Diomede Villalona. Pastor Carlos Peña presented the recourse to suspend the measure until the administrative court hears a contentious appeal that he filed demanding the court annul the regulation.
On Tuesday, 26 October 2021, the Third Chamber of the Superior Administrative Court (TSA) postponed until 2 November, three appeals filed against the same Ministry of Public Health resolution after the recusal of the judge because he was vaccinated.
Legal experts are divided between whether the Ministry of Public Health Law is sufficient to authorize the government to issue the resolution on grounds of collective health or whether the government would need to call a National State of Emergency to legitimize the requirement for the presentation of the vaccination card to enter public places.
