Public Contracting does not give up in lawsuit with Ministry of Education regarding overpriced purchasing

As reported in Diario Libre, the director general of the Procurement Agency (DGCP) Carlos Pimentel stated that it would be very unfortunate for the Dominican people if the decision of the Superior Administrative Court (TSA) to suspend the decisions of the Procurement Agency that ordered the annulment of 45 of 56 lots of electronic devices contracted in December 2020 by the Ministry of Education, allows the awarding of the contracts to be executed and to start delivering equipment and paying under the situations and conditions under which those contracts were given.

With his request for the TSA to expedite knowledge of the merits of the appeal, the Procurement Agency attempts to not give up on its rejecting the overpriced Ministry of Education purchasing contracts.

Carlos Pimentel said on Thursday, 11 November 2021, that he has sent a note to the Superior Administrative Court (TSA) where he requests that a date be set to know the merits of the case, because the precautionary measure suspends the execution, until the appeal is known.

Pimentel pointed out that the DGCP’s decisions are made in accordance with the law, that they are fair, objective, well-considered and technically very robust.

“We will never be silent in the appeals that are submitted to us, we will make decisions and we will always do so in accordance with our conviction, regardless of the ministry,” concluded Pimentel.
