TSA court dismisses appeal on vaccination card presentation requirement

The Third Chamber of the Superior Administrative Court (TSA) has dismissed two appeals that sought to annul a resolution issued by the Ministry of Public Health that requires people present proof of vaccination to enter enclosed public or private commercial buildings. The appellants had filed the appeal under allegations that such a resolution violates fundamental rights as stated in the Dominican Constitution.

Lawyer Yan Carlos Martinez, was one of the appellants, and he said that the decision was a “blow to democracy.” He added that he would pursue further legal action.

The appellants are now headed to the Constitutional Court for a decision regarding the constitutionality of such a mandate by the Ministry of Public Health.
