
Listin Diario is continuing with the series of stories on the need for modernizing Dominican property renting regulations. The newspaper has been covering the downsides to renting in the Dominican Republic. The present laws make it difficult for the owners to retake their property if the tenant violates contractual agreements. Recently, the Constitutional Court ruled reducing the red tape for owners to carry out an eviction. In a recent opinion on the case, the Constitutional Court stressed the importance of better legislation to encourage owners to rent their properties.
Property renting in the Dominican Republic is regulated by a presidential decree and two obsolete laws. These are Law 4314, dated 22 October 1955, amended on 5 February 1988; Decree 4807 on rent control and eviction, dated 1 May 1959; and Law 38-62, which establishes a rate for the payment of rents for houses or apartments destined for family housing.
