
Attorney General Miriam German Brito has appointed Deputy Attorney General Rodolfo Espiñeira to lead the investigations into reports that former Attorney General Jean Alain Rodriguez withheld information on the David Ortiz attempted murder case.
As reported in Hoy, Espiñeira initiated the procedures to have formal access to the report by the private investigation ordered by the former Major League Baseball player to assess its content and determine the steps to follow.
Espiñeira says that the Public Prosecutors Office recognizes the right of all victims to take private initiatives to gather information on their particular cases.
Espiñeira is the first substitute for Attorney General German Brito. Previously he has inhibited himself in the judicial cases concerning her predecessor, Jean Alain Rodrìguez. Rodriguez is currently in preventive custody for 18 months, accused of alleged acts of corruption during his tenure as Attorney General.
Prosecutor Espiñeira’s inquiries would include the prosecutors who acted in the incident in which Ortiz was shot on the night of Sunday, 9 June 2019, in bar owned by the syndicated drug trafficker Cesar Emilio Peralta (Cesar the Abuser).
According to the father of the former Major League Baseball star, from the beginning they both doubted the report of the Attorney General’s Office and the National Police on the investigation of the incident. The law enforcement authorities at the time concluded the case was one of mistaken identity. That is why his son decided to hire a private investigator.
When he learned of the findings made by former Boston Police Commissioner Ed Davis, Ortiz told the Boston Globe that he “felt all kinds of emotions: sad, confused and angry”.
The lawyer of Sixto David Fernandez, who was sitting with David Ortiz at the same table and also was injured by bullet wounds, told Diario Libre that those who had committed the crime are under arrest. The reopening of the case would be to establish who was the intellectual author of the crime. That is, the prosecutors would now have to establish the ties between Cesar Emilio Peralta and the crime.
