Court acquits all accused of corruption in Super Tucano case

The Third Collegiate Court of the National District issued this Monday an acquittal sentence in favor of those involved in the case of the Super Tucano airplanes, declaring them not guilty of the crimes of administrative corruption for which they were accused. The full sentence of the Super Tucano case will be released on 12 July 2021.

Former Defense Minister Rafael Peña Antonio, Daniel Aquino Hernández and Ramón Piccini Núñez were accused by the Public Prosecutor’s Office of receiving bribes from the US$3.5 million distributed by Empresa Brasileira de Aeronáutica (Embraer) to benefit as a supplier of eight Super Tucano airplanes.

When presenting its formal conclusions on 3 May 2022, the Public Prosecutor’s Office asked the court to impose 10 years in prison for Daniel Aquino Hernández, Ramón Piccini Núñez and Peña Antonio for the commission of the crimes with which they were charged. It also requested the payment of a fine of US$7 million.

It also requested the payment of a fine of 100 minimum wages against each of the companies.

Pepca accused the group of accused of violating several articles of the Dominican Penal Code, Law 448-06, on Bribery in Commerce and Investment, and the former Law 72-02, on Money Laundering.

The prosecuting body initiated last November the filing of the indictment against the defendants for bribery, money laundering and illicit enrichment.

The process was initiated in 2016 and the indictment was subsequently filed in 2017. It now continues in the merits trial stage.

The Embraer company, which admitted to the delivery of bribes, was sentenced in 2018 to the payment of US$7 million 40 thousand to the Dominican state.

The investigations in this case included the tracing of money transfers in the country and abroad, analysis and verification of assets, examination of bank account movements, as well as the location and investigation of the origin of assets.
