
Diario Libre reports the new employment regime ordered by the Ministry of Labor for domestic help goes into effect on 19 December 2022. The scheme requires that employers register online or in physical the contracts signed with the employees. The scheme sets a limit of eight hours a day for these employees.
The employers are required to register the employee with the Social Security Office (TSS), with a fixed amount of RD$859.43, of which RD$571.50 is to be paid by the employer and RD$28.50 by the worker. The government will be making a contribution of RD$259.43 to cover the health plan (RD$649.43), the Disability Insurance (RD$95) and the Labor Risk Insurance (RD$115). The TSS has yet to upload the form that will be used for the registry of the workers by the employers.
The employer needs to register the employee in the health plan, regardless of whether the employer has already provided an health plan insurance to the employee, or if the employee is already included because a spouse is insured.
The law does not allow for lowering wages, in the cases where the domestic help makes more than the established minimum wage.
Workers are authorized 14 vacation days after a first year on the job. Those that have more than five years on the job receive the equivalent of 18 days of vacation time. Christmas bonus is required, not so severance payments.
