Constitutional Court orders RD$1.2 million in back pension to widow

The Constitutional Court ordered the Ministry of Hacienda and its Pension and Retirement Agency to pay RD$1,220,000 to a widow. The court supports a sentence issued by a lower court.

The woman had claimed survivor benefits from her husband under the old Dominican Social Security Institute (IDSS) protocols.

The widow had asked for the RD$5,117.50 pension assigned to her husband but which was not forthcoming. In a 2021 sentence (TC-0493-21) the Constitutional Court had already ordered the payment of the pension and added a penalty of RD$20,000 for each day that the decision was not carried out.

In February of 2022, the widow asked the Court to enforce payment of the penalties since she had not received her pension money. As a result, the Constitutional Court issued decision TC-0117-23 on 24 February 2023 and ordered the Ministry of Hacienda and its agency to pay 61 days-worth of penalties.
