Court orders opening of hearing into David de los Santos death

The First Court of Instruction of the National District accepted the request of the Public Prosecutor’s Office and ordered the opening of the trial against those accused of the death of David de los Santos Correa. De los Santos Correa died due to consequences of the blows he received in the jail of a police detachment that held him after being retained and handed over to the police by members of the security of the Agora Mall. When he was taken to a public hospital, he did not receive adequate medical treatment, either.

Judge Raymundo Mejía ordered the trial of the civilians Santiago Mateo Victoriano, Michael Pérez Ramos and Jean Carlos Martínez Peña, and of the members of the National Police, Captain Domingo Alberto Rodríguez Rodríguez, Second Lieutenant Germán García de la Cruz, Private San Manuel González García and/or Private Sari Manuel González García and Corporal Alfonso Decena Hernández. The later is charged with the crime of torture and barbarism.

Magistrate Mejía issued the same sentence against the accused Ambriori Montero Otaño, Álvaro David Beltrán Pérez, Yubaris Méndez Ferreras and Juan Reyes de la Cruz, private security of the Ágora Mall.

The full reading of the court’s decision is set for April 20.

The court accepted the evidence presented by the prosecutors representing the Public Prosecutor’s Office, Magalys Sánchez, María Silvestre and Laura Vargas, which compromised the responsibility in the facts of Ágora Mall.

David de los Santos Correa, 24 years old and resident of Los Alcarrizos, died on 1 May 2022, at the Doctor Dario Contreras Hospital, after being detained at the police station of the Naco sector, where he was kept from around 9pm on 27 April by the police agents who received him on behalf of the private security of Agora Mall who had detained him for allegedly presenting security inconveniences inside the shopping center.

The Public Prosecutor’s Office accused Santiago Mateo Victoriano, Michael Pérez Ramos and Jean Carlos Martínez Peña, for the commission of association of criminals to commit voluntary homicide, torture and barbarism, in violation of articles 265, 266, 295, 303-4 numerals 2 and 9 and 304, of the Dominican Penal Code.

The judicial instance establishes that police captain Domingo Alberto Rodríguez Rodríguez, second lieutenant Germán García de la Cruz, private San Manuel González García (Sari Manuel González García) and corporal Alfonso Decena Hernández committed abuse of authority, illegal detention and confinement, voluntary homicide, torture and barbarism, in violation of articles 186, 198, 265, 266, 295, 303-4 numerals 2 and 9, 304 and 341 of the Dominican Penal Code and article 153 numerals 3 and 4 of Law 590-16 Organic Law of the National Police.

Meanwhile, the accused Ambriori Montero Otaño, Álvaro David Beltrán Pérez, Yubaris Méndez Ferreras and Juan Reyes de la Cruz, private security of the Ágora Mall, incurred in the commission of illegal detention and confinement, to the detriment of De los Santos Correa (deceased) because there is sufficient evidence that compromises their criminal responsibility.
