
The Constitutional Court rejected an attempt to revoke the Ministry of Labor practice on deciding on Dominican holidays and on the off-days these create. The Constitutional Court addressed a request to revoke Dominican Holidays Law 139-97. The citizen sought to impede that days such as the birthday of Juan Pablo Duarte, the forefather of the country, be celebrated on the previous or following Monday.
The court argued that the Constitution impedes the examining of decisions of the Supreme Court that are previous to 2010.
The Supreme Court had decided in 2008 that Law 139-97, which changes the celebration of certain holidays to Monday if the holiday falls on a Tuesday, Wednesday, Thursday or Friday was not unconstitutional. The decision by the Constitutional Court was not unanimous with two judges filing dissenting briefs and three judges abstaining.
