
It is highly unusual for a governmental agency, in this case the nation’s highest court on Constitutional issues, to go public with the failures of other government entities to comply with the decisions handed down. But the Constitutional Court (TC) did just that. Take note the Constitutional Court is the court of last resort in Dominican justice
On their website last week, the TC published the names of more than 50 government institutions that have ignored or defied decisions as handed down by the TC. These institutions include the National Police, the Armed Forces, city governments (Ayuntamientos), different ministries, and even the Presidency of the Republic. Even the Dominican Red Cross is mentioned.
The Constitutional Court also mentions the Pension Fund Administration of the Popular Bank as private entities that have not respected their rulings. Many of the failures to comply have to do with the re-hiring of personnel, including members and officers of the police and armed forces, as well as employees of the various government and private agencies and institutions.
Other failures to comply deal with payments due for government appropriations of lands or real estate. Even pensions payments are detailed, as the city of Santiago has not paid the pension of one of its former mayors. This is probably a first in Dominican politics and government, where the dirty laundry is hung out in public.
