
The Dr. Ney Arias Lora Traumatological University Teaching Hospital filed an appeal for review before the Constitutional Court regarding Sentence SCJ-TS-24-0126 issued by the Supreme Court of Justice. The ruling requires the Ministry of Hacienda to pay on behalf of the hospital RD$10 million after losing a lawsuit for a case that occurred in 2016, in which a young man lost a leg, as a result of a bacteria he would have contracted in the hospital.
The sentence was handed down by the Third Chamber of the Supreme Court of Justice. The hospital and the medical association seek for the ruling to be reviewed “because the defendant was not allowed to present expert evidence, nor the review of management protocols, nor the review of the guidelines.”
“We trust that the honorable judges of the Constitutional Court will be guarantors of fundamental rights and a fair and equitable application of the legal norm for all parties, to continue guaranteeing the rule of law that we live in in the Dominican Republic,” indicates the document sent to Hoy Digital.
At the same time, members of the Dominican Medical College (CMD) protested on Thursday, 18 April 2024 morning in front of the Supreme Court of Justice (SCJ) in “repudiation of the celebration of condemnation against doctors, private clinics and hospitals” for alleged bad medical practices.
During the demonstration, the president of the CMD, Dr. Waldo Ariel Suero warned Luis Henry Molina, head of the Supreme Court of Justice of the Dominican Republic, that this is just the beginning of the CMD’s fight, because they are firm and determined to defend their members.
The increase in judges awarding lawsuits against hospitals and physicians is leading to an increase in the cost of medicine in the Dominican Republic.
