Constitutional Court annuls rule imposed on survivor benefits

The nation’s highest court, the Constitutional Court has ruled on a resolution passed by the National Council on Social Security (CNSS), which established an age limit for a person to receive a disability or survivor’s pension, as well as a time limit to file for such benefits.

The Constitutional Court ruled that Social Security Law 87-01 “does not establish a [time] limit for exercising these rights.” This decision effectively nullified Resolution 569-03 from April of 2023.

The higher court said that the CNSS had given itself an attribute that the law dd otherwise establish, which was to “create, via regulations, limitations or dispositions not foreseen in Law 87-01.”

The case was brought before the high court by several prominent lawyers and a group of associations, foundations, and the Dominican Human Rights Council. The CNSS measures had severely restricted the access of affiliates to obtain the benefits that were due.
