Prosecutors reject new prosecutor contest, take case to Superior Administrative Court

For the first time in history, a large number of prosecutors are rebelling against their boss, the Attorney General. As reported in Acento online news portal, 18 active prosecutors from the Public Ministry are contesting the rules of the internal contest for the selection of prosecutors proposed by the Public Ministry’s Career Office and extended and approved by the Superior Council of the Public Ministry, headed by Attorney General Jean Alain Rodríguez.

They are contesting decisions reached by the Superior Council of the Public Prosecutor’s Office, whose members are Jean Alain Rodríguez, Ana María Luisa Burgos, José Manuel Aguiló Talavera, Edward Manuel López Ulloa and José Andrés Comas Abreu, as well as the engineer Víctor Lora, director of the Public Prosecutor’s Office career department.

Lawyers Laura Acosta Lora, Nassef Perdomo Cordero and Cristóbal Rodríguez Gómez represent the 18 members of the Public Prosecutor’s Office. They argue that their petition is based on Article 165 of the Constitution of the Republic, Article 1 of Law 1494, which creates the Superior Administrative Court, Law 13-07 on the transition to jurisdictional control of the State’s administrative activity, Law 107-13 on the rights of individuals in their relations with the administration and Article 74 of Law 133-11 on the career of the Public Prosecutor’s Office.

They explain that the Public Prosecutor’s Office has a career system that is regulated by the Constitution of the Republic. This career system ensures that the members of the institution are irremovable to ensure their independence of action.
