
The Constitutional Court (TC) revoked a ruling issued by the Superior Administrative Court (TSA) that had ordered the Central Electoral Board (JCE) to cancel the disqualification of the birth certificates and identity cards of eight persons who had obtained these in an irregular manner.
The JCE’s refusal to issue identity documents to Zeneida Napoleon Basilio, Danilsa Yan Napoleon, Welinton Yan Napoleon, Rosa Milsi Yan Napoleon, Claudio Alexander Yan Napoleon, Massiel Bautazal Basilio, Alvaro Basilio and Leyda Feliz Basilio, was made after an administrative investigation that had determined that the civil registry entries of these persons were irregular.
Ruling 03-2018-SSEN-00320 of the Second Chamber of the TSA court ordered the JCE to issue each plaintiff a provisional identity document of restricted use for labor, financial and social security purposes while the process of certification of birth certificates through the corresponding legal channels continued.
The JCE filed an appeal for constitutional review before the Constitutional Court that accepted the appeal in response to this sentence.
On 3 January 2022, the Constitutional Court issued a sentence ordering the revocation of the decision of the TSA, at the same time it declared inadmissible the recourse filed by the eight claimants.
