Superior Administrator Court voids demands for back pay by injailed PRM legislator

The Second Chamber of the Superior Administrative Court (TSA) voided a lawsuit filed against the Chamber of Deputies by Deputy Miguel Gutiérrez Díaz. The ruling Modern Revolutionary Party (PRM) deputy is seeking payment of salaries for months he has been in jail in the United States accused of drug trafficking.

The action was filed after the president of the lower house, Alfredo Pacheco, ordered the withholding of all salaries, allowances and benefits of the deputy, imprisoned in Miami for drug trafficking. The PRM legislators have yet to initiate actions to replace the legislator.

Court judges Antonio Sánchez Mejía, Alina Mora Mármol and Cecilia Badía Rosario accepted the request for annulling the request made by the Chamber of Deputies and the anti-corruption administrative agency (Pepca) of the Attorney General’s Office.

By judgment No. 0030-03-2023-SSEN-00151, dated 28 April 2023, the judges ordered the court secretary to notify the decision to the plaintiff Gutiérrez Díaz and to the defendant Chamber of Deputies and the Administrative Prosecutor’s Office.
