Looking for new judges for the Constitutional Court

President Luis Abinader led the first meeting of the National Council of the Judiciary (CNM) on Tuesday, 10 October 2023, opening the process to replace five of the current 13 judges of the Constitutional Court.

During that first meeting at the Presidential Palace, the agenda to be followed in selecting the new members of the high court was discussed.

All the members of the CNM attended the work session. These are the president of the Senate, Ricardo de los Santos Polanco; the president of the Chamber of Deputies, Alfredo Pacheco; opposition senator, Bautista Rojas (Fuerza del Pueblo), and opposition deputy, Víctor Fadul (Dominican Liberation Party – PLD).

Likewise, the president of the Supreme Court of Justice, Luis Henry Molina; the judge of the Supreme Court of Justice, Nancy Salcedo Fernández, and the Attorney General of the Republic, Miriam Germán Brito. The legal advisor to the Executive Branch, Antoliano Peralta and judge Nancy Salcedo serve as spokespersons for the National Council of the Magistracy.

The mandate of five judges of the Constitutional Court expires on 27 December 2023. The judges that need to be replaced include Milton Ray Guevara, chief justice. Other judges to be replaced are Lino Vásquez Samuel, Rafael Díaz Filpo, Justo Pedro Castellanos Khoury and Víctor Joaquín Castellanos Pizano. These were appointed in 2011 and are the last five judges of the original court that would begin its formal work in 2012.

Submissions of candidates to replace the retiring judges are open from 11 October to 7 November 2023. The public hearings to choose the judges will start on 17 November 2023.

The program establishes that the new judges be sworn in by 21 December 2023.

During the meeting on 10 October 2023, new regulations for the application of Law 138-11 were approved. These will go into effect for the next CNM call. For the present selection, the rules in Regulation 1-17 will apply. For the next CNM call, the rules will be known as 1-23.
