
The Constitutional Court (TC) annulled a ruling that had ordered the return of three properties and the lifting of the freezing of a bank account to Jesús Pascual Cabrera Ruiz. Cabrera Ruiz had been sentenced to 20 years in prison in December 2022 for complicity in attempted murder and other crimes.
The revoked sentence is #047-2021-SSEN-00035, issued on 12 March 2021 by the Ninth Chamber of the Criminal Chamber of the Court of First Instance of the National District.
Through sentence TC-0642-23, the Constitutional Court accepted an appeal for review filed by Luis González, head of the Specialized Anti-Money Laundering and Terrorist Financing Prosecutor’s Office, and Francisco Rodríguez, Court Attorney General of the Specialized Anti-Money Laundering and Terrorist Financing Prosecutor’s Office, on behalf of the Attorney General’s Office of the Republic.
The annulled sentence had ordered the return to Cabrera Ruiz of property in La Romana and the lifting of the immobilization of a bank account for the amount of RD$28,393,667.00.
The sentence of the Constitutional Court is supported by the dissenting vote of Justice Domingo Gil and the dissenting opinions of Justices Rafael Díaz Filpo, first substitute, and judge Alba Luisa Beard Marcos.
