Supreme Court reaffirms banking secrets

The Penal Chamber of the Supreme Court of Justice (SCJ) has handed down a decision that confirms one of the rules of banking in the Dominican Republic. The Supreme Court of Justice ordered the keeping of confidentiality and secrets of an entity’s negotiations with the financial institution and the prohibition of sharing such information with third parties without a judge’s warrant to such an action.

The SCJ considered banking secrets to be a “fundamental right” of the bank clients.

The case was brought to the Supreme Court by the Tax Agency (DGII) regarding a case related to tax fraud.
