More kudos than boos in selection of new judges for Constitutional Court

There have been more congratulations than skepticism or criticism of what the future will bring now that five judges have been appointed and a new president of the Constitutional Court named. The five new judges can mark a change in the path of the court that began its work more than 12 years ago as part of a general revision of the Dominican Constitution.

The National Council of the Magistracy (CNM) chose Napoleón Ricardo Lavandier to preside the Constitutional Court, and judges Fidias Federico Aristy Payano, Amaury Amílcar Reyes Torres, Sonia Argentina Díaz and Dianny Esperanza Ferreira Féliz for nine-year terms.

Diario Libre has covered the remarks opposition leaders senator Bauta Rojas for the Fuerza del Pueblo (Leonel Fernandez) and presidential candidate Abel Martinez for the PLD (Danilo Medina) made when protesting that President Luis Abinader used his majority in the National Council of the Magistracy to impose PRM friendly judges. The same newspaper’s editorial remarks the PLD had likewise imposed its majority to choose the presidents of other high courts in the past.

Benjamin Morales editorialized in Diario Libre that the biggest challenge confronting the new president of the Constitutional Court is that the government sectors enforce the implementation of the rulings issued by the highest court and that more Dominicans be informed of their rights and duties according to the Constitution. Outgoing president Milton Ray Guevara has complained that the Ministry of Education has not allotted adequate space for teaching the Constitution. Decades ago, the Ministry of Education removed the subject “Moral y Civica” in which high school students were obliged to learn the Constitution.

Meanwhile, the Association of Industries of the Dominican Republic (AIRD) and the National Business Council (Conep) joined those who congratulated the selection of the few judges.
