Superior Electoral Court orders recount of lawyer guild election votes without last minute alliance

On Friday, 12 January 2024, the Superior Electoral Court (TSE) ordered the Bar Association of the Dominican Republic (CARD), through its National Electoral Commission, to carry out a new count of the votes cast in the elections held 2 December 2023.

This recount need to be done without applying the alliance agreements approved by Resolution CNE-(CARD)-009-2023 because the latter failed to meet legal requirements. In that sense, the votes must be counted separately for each candidate, leaving only the regularly approved agreements in force.

The high court ordered that the sentence be executed within a period of no more than five business days, as of Monday, 15 January 12024.

The TSE accepted the extremely urgent amparo action on the merits, “because the plaintiffs have demonstrated a violation of their fundamental electoral rights within the framework of the right of association, contained in article 47 of the Constitution, and a violation of due process. process provided for in article 69 of the Magna Carta, consequently, annuls resolutions CNE-(CARD)-009-2023 of December 2 (02), two thousand twenty-three (2023) and CNE-(CARD)-0011 -2023 of 11 December 2023, issued by the National Electoral Commission of the Bar Association of the Dominican Republic (CARD)”.

The decision affects the CARD announcement that gave the victory to Vidal Trajano Potentini who represented the coalition of the opposition parties — Dominican Liberation Party (PLD), Dominican Revolutionary Party (PRD) and People’s Force (FP). Vidal Trajano Potentiti said the decision was a gross immersion of the government into guild affairs. He said he will take the case to the Constitutional Court. He said the Superior Electoral Court does not have jurisdiction to decide the case. That the matter is an issue that corresponds to the Superior Administrative Court (TSA).

Trajano Potentini competed against Yhoan López, who had the support of the ruling Modern Revolutionary Party (PRM). If the last minute coalition votes are discarded, Lopez would win the CARD election.
