Bautista case needs to be heard by all Supreme Court judges

The judges of the Second Penal Chamber of the Supreme Court of Justice have declared themselves incompetent to hear the recourse presented by Attorney General Francisco Dominguez Brito in opposition to the decision taken by the director of the National Department for Administrative Corruption (DPCA), Hotoniel Bonilla. Shortly before the end of the Leonel Fernandez government, Bonilla announced that of the corruption case against senator Felix Bautista would be filed permanently for lack of evidence. Dominguez Brito has requested the reopening of the case on grounds that to not do so would be to not fulfill his role. The penal chamber judges said that the senator for San Juan de la Maguana has privileged jurisdiction, so the request for opening the corruption case must be heard by the full assembly of Supreme Court justices.

On 13 August 2012, the DPCA issued auto No. 03093 by which it definitely shelved the file containing complaints made by the opposition PRD party, civil society organizations and media of alleged acts of corruption committed by the senator. These included TV journalist Nuria Piera, acento.com.do, Alianza Dominicana Contra la Corruption (Adoco), Convergencia Nacional de Abogados (Cona), Josefina Juan de Pichardo, Juan Tomas Taveras Rodriguez and Rafael Percival Pena. The DPCA said that the accusations had been made in the days of the 2012 presidential electoral campaign and did not include compromising evidence against the senator, as reported in Listin Diario.
