According to what has been established in the Judgment TC/0168/13 issued by the Constitutional Court on 23 September 2013, the former mayor of Santo Domingo and leader of PRD, the late Jose Francisco Pena Gomez would continue to be Dominican, regardless of any review of the documents of the time. The note in El Caribe points out that unless the contrary is proven, despite being the son of an illegal Haitian, Oguis Vicent, Pena was the son of Maria Marcelino, a Dominican through whom he was granted Dominican nationality. Also, the politician was legally adopted by a Dominican family.
The sentence ordered the legal entities to review the cases of people who despite being the children of illegal parents had obtained legal Dominican documentation since 1929.
