Kook Young Jo of Posco Engineering & Construction Co, one of the companies authorized to take part in the government bid for the construction of two coal-fired generators, disputes the right of the consortium created by Odebrecht of Brazil and Technimont of Italy to be included in the bid. The South Korean company’s representatives say that Tecnimont should not be allowed to participate because it did not disclose information that it has two legal cases open in Chile. The firm says that if a company has a legal case pending that it did not disclose it should be excluded from the bid. In a letter to government procurement director Yokasta Guzman, Jo says that Tecnimont has an arbitrage case pending against Endesa Chile (Grupo Enel) for a year-and-a-half delay in the start of operations of Bocamina II in Chile where a US$94 million guarantee has been executed. The same company is also being sued by Colbun for US$300 million for delays in the construction of the Central Santa Maria coal-fired plant, where a US$104 million guarantee has been executed. He also revealed that Tecnimont had a conflict with Brazilian company MPX and EDP Energy of Brazil and that contract had to be revoked.
