The reasons for revoking Penal Code

The Constitutional Tribunal of the Dominican Republic published Ruling 0599/15 yesterday, Thursday 17 December 2015 on the decision that annulled Law 550-14 with the new Penal Code of the Dominican Republic, outlining the reasons for annulling the validity of the new Penal Code.

“The procedural error to which we have alluded inevitably affected the validity and constitutionality of the new Criminal Code and, therefore, it must be annulled without having to temporarily defer its effects because it has not yet entered into force,” says statement 0599/15 containing the decision that was published on 17 December 2015.

The TC said that the law enacted by the Executive Branch in December 2014 was not subject to discussion and vote by the Senate after changes were made in the Chamber of Deputies, as established by the Constitution.

The last resort court said that it only considered the form and not the content of the request for violation of the Constitution on articles 107, 108, 109 and 110 of the Criminal Code related to abortion presented by Justice and Transparency Foundation (FJT), the Transparency and Democracy Foundation and the Happy Marriage Foundation.
