No decision yet on Notary Law

The Constitutional Court has not ruled on the complaint submitted by the Commercial Banking Association (ABA), the Association of Savings and Credit Banks and Credit Corporations (ABANCORD) and the Dominican League of Savings and Loans Associations (LIDAAPI) who claim that the new Notary Law violates the Constitution.

The court, chaired by Milton Rau Guevara and made up of other judges, heard the plaintiffs, which included the Dominican College of Notaries, and decided not to pronounce their sentence until the next hearing.

The plaintiffs’ lawyers, Francisco Alvarez Valdez and David Maluf Jorge, said that the new Law does not conform to the regulations which govern the Dominican Notaries’ Institute and the Dominican College of Notaries, while the College, the Senate and the Attorney General’s Office have stated that the new tariffs which notaries should charge are reasonable and conform to the Constitution.

Doctors Pedro Rodriguez Montero and Nelson Rafael Santana Artiles, president of the College of Notaries and the legal representative of the College, maintained that they were obliged to comply with the Constitution and the Notary Law.
