The Supreme Court of Justice ruled that before banks or financial institutions debit people’s accounts, the account holder must be duly notified, even when the funds were erroneously deposited.
The decision (0961/2021) states that no banking or financial entity may debit from the accounts of depositors any value without due notice, authorization or knowledge of the account holder.
The decision was made by judges Pilar Jimenez, Justiniano Montero, Samuel Arias, Vanessa Acosta and Napoleon Estevez, who established in the ruling that such illegitimate action constitutes a violation of rights and could result in a civil liability suit.
The Supreme Court justices issued the decision on 24 May 2021 in response to an action filed against a financial intermediary for illegal debiting of a sum without previous notification.
