Does it matter where you were married? I need a divorce, was married in NYC but my husband is somewhere in DR and not sure where.
Typically for a court to have jurisdiction over a divorce, you or your spouse must be resident for a certain period of time in the state/country where you are filing. I would think it would be significantly easier for you to file in a US jurisdiction if you are a resident there.

I'd consult with a lawyer here (better in the legal forum). If I'm not mistaken, a three day notice in local newspapers is all that's required when you can't find the person.
Yes, unfortunately I am. I contacted a lawyer over there in DR but he aid he doesn't know if the divorce would be recognized here in NYC. Do you mean a notice in the paper in DR?

Hi Kat, Yes. That is what I meant.

But as the lawyer here told you, I'm not sure that's enough for a divorce to be recognized in the U.S.

You may be able to do the same thing there with a local newspaper.

Can't you visit a legal aid office up there and ask them? It doesn't make sense a person would have to be married forever because the spouse can't be located.

In the US, a person can absolutely get divorced if the spouse cannot be located. It usually just requires the court to grant an alternative method of service (i.e. publication as you noted).
