3yrs ago when he was 18yr he had sex with his girlfriend while she was 14yr.

He reached out to the family but their response was ?give us the money or we are putting you in jail.

He requested a copy of the legal papers and today he received a document from the MINISTERIO PUBLICO that looks like a complaint.

Sorry for the many question but we are worry.

He is now 21 and she is now 17. If she's been active since she was 14 then she's probably caught a blessing (as in bundle of joy) by now and is desperate enough to pull any chain she can get her hands on to get money. The family has schemed this up and they are totally in cahoots, after all, he's in Nueva Yol and making plenty of loot so what's 4 Grand? Two days of any half decent lawyer's time costs more than that.

The problem with the scheme is that the kid is Dominican and a complaint is not a judgement. It's just a filled out form and even if filed it means nothing without a judgement. It doesn't sound like the family has retained the services of a (real) attorney. They're doing a shakedown and hoping for the best. The problem with just paying the 4 Grand now to be done with it is that this particular cow will be milked every time their pail goes dry right up until the guy has had enough and they move on to the next victim for the next scam.

There probably is a statute of limitations on this kind of claim and it's probably expired. It's worth doing a little research to find out before even consulting an attorney. There are public libraries in Nueva Yol with books and computers and everything.

This is one of many, many scams and they're coming up with new ones every day.

There is no claim yet. They are threatening him to file a complaint. Will it be a criminal complaint ??? What does the Dominican criminal law say about prescription of a criminal act ????????

We could talk about what the Canadian Criminal code, the Florida, Arizona criminal laws ( or USA criminal law) states about prescription of a criminal act but it will not be of any LEGAL help for the OP.

Everyone thanks again for your comments, we are beginning to breath a little easier. We are in the process of retaining a DR lawyer and are now vetting recommendations.

An arrest warrant via the US legal system can be enforced with ease on cases like this one.

Pichardo can you elaborate on this, how likely is this, do you know of any cases.

Criss Colon, as a born and raised Dominican and father to a little girl, your comment is extremely insulting and far from the issue. Please provide constructive opinions ONLY.

If this is the stereotypical desperada you should know she might talk a game, but she will let herself down when it comes to knowing how to involve legal proceedings. In my experience they ain't got a clue, and certainly not the energy to seek advice from a professional with any weight. At best they will know someone who once read a law book and now deals in filing for birth certificates fir fatherless children. She is 17, no one is going to listen to her story in a million years.
