I disagree, but then I am not familiar with every corrupt local government. IF you can get to the beach by not walking on private land, you have every legal right to be there.
You have a right but they will hassle you until you leave. Less if you are a tourist. I thought access needs to be provided? I could be very wrong about that.

Access through private land does not need to be provided. There are not laws that force that to happen. Governments that fail to allow for this and not create right of ways for the public are what is causing the protests.

I suspect the protests will not lead to any change in the case of the OP. People will either pay a fee or not get to that section of beach.

I understand that the local owners will hassle people, but they have no right to do so if you are already on the public 60 meter beach area.

I've walked a lot of the Boca Chica and Andres beaches. Never had a problem. "Sitting at a table? Totally different."
"Sitting at a table? Totally different." By this, do you mean you actually have to buy something?, I've seen the same Euros for years sitting at restaurant in BC and not buying anything

Yea. From what I've seen, you can bring your own food and drink, but then you have to pay a fee for the table. It's been so long since I tried I don't know how much anymore.

On the beaches in San Cristobal, if you order food the tables and chairs are free. If you don’t, I think it’s 500 pesos to “rent”. Some restaurants also have beach lounges, some charge, some don’t.

Also, the beach food is super expensive. I take the 2 grand nephews and we have chicken, fries, and 2 drinks a piece. Over 4000 pesos before tip.

In Boca Chica the high prices are legendary. Woe be to the person who orders without looking at a menu with prices.

Interesting Subject. According to law; you could access every beach, even of the most luxurious Resort by Boat or even by walking at the shoreline.
Practically there is no way that they let you. Anybody ever tried ?
It would be interesting if this law only apply to natural beaches or all beaches. While most Dominican beaches are natural, some like Minitas Beach in Casa de Campo I think are artificial.

Artificial might not apply to recently created beaches by nature such as a beach that recently created itself in Sosúa.

Some beaches are artificially improved even if originally the beach was made by nature. A good example is Boca Chica Beach. It looks nicer where the Hamaca resort is and I don’t think that’s coincidence.

I would guess it applies to ALL beaches, since the law has no exception for created beaches. So , create a beach at your own risk, or make sure you own all of the land around it first.

The court decision had ordered the immediate removal of any barriers impeding free access to the beach, confirming its status as a public property. Ruling TC/0245/22, issued in 2022, upheld the previous ruling by the Civil and Commercial Chamber of the Court of First Instance of the Judicial District of Puerto Plata, which partially granted the amparo action filed by the Association for the Protection, Development, and Free Access to Encuentro Beach (APRODELAPEN) and several citizens.
The decision established that Encuentro Beach is a public space and that any obstruction would violate fundamental rights protected by the Constitution.

It's about time the people who are putting the barriers there are punished for blatantly ignoring the court order.
