situation :
the shengen country which delivers a shengen VISA to a domincan is responsible for this incoming person.
Shengen means free move of people and money.
A french talking person may go to germany.
Some shengen countries laws says that to inmigrate to their country the people has to pass a language test in : French in France, German for Germany etc....

QUESTION:
Why may a spanish talking dominican going to germany may not do the test in Spanish since he does not only goes to Germany but also in SHENGEN where they talk many languages?
Maybe after some time he will move to another SHENGEN country.
QUESTION:
are these arguments sufficient to go to STRASBOURG to the court?

Well, first, the agreement is spelled Schengen.
The Schengen visa, which allows access to all countries, and the same application rules wherever you apply, is a 90-day tourist visum. It has nothing to do with immigration rules, that is if you want to stay longer or take up permanent residence. Each Schengen country still has its own immigration rules, and some require a language test, others don't. There is no language test involved in the application for a short-stay Schengen visa. And many countries do not even have a language test for long-term immigration.
You are right that there is some unfairness in those language tests and freedom of movement within the EU (not Schengen), in that citizens of any EU member state can go live and work in any other EU country, whether or not they speak the language, while citizens from non-EU countries do need to pass language and other tests to receive residency or working permits in some EU states. There is further unfairness in that sometimes this does not apply to citizens of some non-EU states like the US or Japan, while it does apply to others like the DR or Haiti. Please take this matter to the European Court of Justice in Luxembourg or the European Court of Human Rights in Strasbourg and let us know how it goes...
