The Supreme Court of Justice rejected an appeal by the promoters of a second international airport in the Punta Cana area. The Supreme Court responded to a request by the Corporación Aeroportuaria del Este, a Grupo Puntacana affiliate, filed on 5 March 2020. The Corporación Aeroportuaria del Este is the owner and operator of the Punta Cana International Airport.
The Supreme Court rejected a cassation appeal filed by the Abrisa Group and the Bavaro International Airport against a resolution of the Superior Administrative Court (TSA) that opposed the construction of the second international airport in the eastern beach destination.
As reported in Listin Diario, the Third Chamber of the Supreme Court of Justice issued its opinion in judgment number SCJ-TS-23-0507 dated 28 April 2023, signed by judges Manuel Alexis Read Ortiz, Manuel R. Herrera Carbuccia and Anselmo Alejandro Bello.
The appeal sought to annul a judgment issued by the Superior Administrative Court (TSA) that revoked resolution 007/2020 of the Ministry of Public Works that had cleared the construction of the Bavaro International Airport. A resolution of the Airport Commission issued on 23 January 2020 had granted its no objection to the development, construction and operation of the Bavaro International Airport by the Abrisa Group. Abrisa Group is the developer of Cap Cana, a leading residential and touristic development in the Punta Cana destination.
