After accepting the Public Prosecutor's request, a collegiate court sentenced a man to 30 years in prison for killing a foreigner in Ensanche Dubreau (Los Callejones), Puerto Plata, on January 16, 2023.
Waster Rafael Mancebo Pérez was found guilty of the murder of German citizen Gunther Holger Botschek, which occurred in a home in the aforementioned area after a dispute over the property.
The trial established that the convicted man falsified a sales contract for the land owned by the foreigner in 2021, whose signature was verified as non-authentic by the National Institute of Forensic Sciences (INACIF).
Regarding the case, the file prepared by prosecutor Julio César Gómez Quintana indicates that Mr. Botschek's lifeless body was found in said home with obvious signs of violence and a puncture wound to the occipital region of the skull.
The now convicted Mancebo Pérez was found next to the body, with blood stains on his hands and nails, evasive.
The judicial autopsy report No. 043-2023, issued by Inacif, indicates that the death was caused by severe multiple blunt force trauma, resulting from blows inflicted with blunt objects.
The body also showed signs of strangulation, multiple lacerations to the chest, neck, face, and other parts of the body. The cause of death was cerebral hypoxia, which was classified as a violent death of medico-legal homicide.
The Public Prosecutor's Office, represented at the hearing by prosecutor Karen Lidia Santana, proved the convicted man's guilt before the court presided over by Judge Jakayra Veras, who accepted the expert, material, testimonial, and audiovisual evidence provided by the prosecution as valid and admissible.
The incident was legally classified as a violation of Articles 150, 151, 295, 296, and 302, which punish the crimes of murder, forgery, and use of false documents, as defined in the Dominican Penal Code.
The sentence imposed must be served at the San Felipe Correction and Rehabilitation Center (CCR) in Puerto Plata.
