The attorney's information is correct. NY State, unlike some states, requires that the papers are personally served (given) to the respondent (spouse) in a divorce proceedings. This is to prevent fraud. The exception to the rule, as the attorney informed you, is to inform the judge that you do not know your husband location and to provide details. The judge can then permit you to use another form of service, like certified mail, publication in a newspaper, posting the complaint on the door of his last known address, etc.

From the information you provided, you may be able to do this yourself. This would include the length of time of the separation, no children and no property to divide. You must file the complaint, and then arrange to discuss the matter with the judge. You probably would have to file a motion. Call the clerk of the court and explain your situation and asked for assistance. Sometimes, especially in non-complex cases they can be of great assistance.

Your "2nd opinion" gives the OP what seem to me a basis for going forward without bankrupting herself to obtain a divorce.

here are the actual procedures for divorce in nys

which is sorta funny.. sorry..not funny to you Kat,, but funny in that.. well,,, they have abandonment but are still saying that the other party must be served.

They do say consult the Embassy or Consulate..

And I have seen notices posted here in the paper about Listin Diario.. but the Embassy here used to have a phone line for citizen services which they seem to have discontinued.

But there is probably something more in the law about what constitutes notification. I would look around NY for a DOMINICAN lawyer .. who proabably knows this sort of thing.. about how these things are handled.. and just pay for a consult on the law.

The rest looks like you actually can do it yourself.

But if the guy left 10 years ago, you ought to be able to just publish it here in the paper of record and be done with it.

Thanks for your help I will actually try all of these things because the facebook profile for him that I messaged he didn't respond to.

I really thought that I needed to find him to divorce him. I consulted with one lawyer and didn't hire him but that was the advice he did give me. I have a cousin who lives in DR and she said she was able to find his phone number. I did call but he never answered. I really don't need to find him if I don't have to I just thought that I needed to. Thank you for your advice and support.
