frank's formula is somewhat close enough, it's about a month's salary per each year of work (or a cut of thereof if it's less than a year) but it's based on the last 12 months of wages. so if a person started at 10k pesos but finished on 20k pesos a month the liquidation will look at the data from last year. then there is also holidays, the proportion of the salary, notice and so on. he simply worded it badly when he shared the info.

in any case, it's a good decision. if the business may be closed for months or even years it makes no financial sense to continue paying salaries. it only extends employment period that would still count for liquidation calculation. and one can always re-employ the workers if the problem is solved earlier than anticipated. and some people receive enough money to be able to open a small business of their own.

Sky, I have not altered what i have said from the beginning. I reiterate, everyone gets paid 10% of their income. Of course, it goes without saying, this is for every year that they work for you.

It's called a 10% severance pay, because for every year that they work for you, you are supposed to set aside 10% of their earnings. The Severance pay begins after 90-days of work.

Frank, you are a nice guy. And Big Frank says that you are OK. That means you are also OK with me. But originally you said everyone got 10% of their salary WITHOUT mentioning that it was for each year working there. If you did put it as you do now I would have never responded. Get it I hope................

I understand, but i thought you would know that it is for every year that someone works for you. I thought everyone living here knew this.

I did know it, but apparently some others did not and questioned you on it. Let's put this to bed. Saying that everyone got 10% of one year's salary without mentioning that is for every year working is not correct. Assuming that everyone here knows it is per year is not correct either. So let's just move on please.

I think we should make this saga into a movie. We could call it Rocky and we could follow up with Rocky 2, 3 etc. Frank12 could be played by someone like …. Sylvester Stallone?

Agreed. There's obviously a contract pertaining to the sale. Don't know why a buyer would agree to pay liquidation pre ownership. Makes no sense.

You are correct. Frank did pay the employees liquidation when he sold.

Yes, Big Frank paid liquidation when he sold it. Rocky paid them this week for the 1.5yrs that they worked for him.

The Old Jose's was great and I would eat drink there everytime. When I saw the new Rocky's and the puky color, I said nope. Should have kept it the way it was IMHO

That has essentially been my take on it as well ..
They tried to change a Classic Irish theme Sports / Drinking bar where Old timers and first Timers felt " at home"
into a Trendy Hangout spot for Trust fund , Euro Trash as stated before... And as COOL as that may seem in Concept , it don't pay the Bills ... If they even lost just 20 % of the OLD Customers because of these changes , they had already lost

Just potential customers .
Changing the whole COLOR theme was also a very Risky Gamble ..

Only a color that would make people look jaundiced instead of like death warmed over would have been worse, but I thought it was just me. I did not frequent the location and its previous business and it certainly was less attractive after the make over.

Glad we understand now the how and why of the legal obligations to the employees that were taken care of. Nothing altruistic about that.

Any results from the courts on what is next?

This has always been the law, and it is enforced by the Labor Bureau here.
