Marlin and Marlon Martínez are facing two charges in connection with the death of pregnant teenager, Emely Peguero whose body was found inside a suitcase in a road in Cayetano Germosen in Espaillat province.
The Public Prosecution Service are accusing mother and son of murder, complicity, torture and barbarous acts, hiding the corpse, abduction and holding and illegal traffic of a minor to the detriment of Emely Peguero.
The lawyers for Emely’s family are accusing the pair of murder, aggravated homicide and complicity in murder. They are also asking for a payment of RD$20 million from the Martinez family.
Given both charges, the lawyer of Marlon Martínez, Ricardo Reyna, has questioned the witness statements that the Public Prosecution has referenced, and has said that he will challenge the veracity of three of the witnesses who will be giving damaging statements. Lawyers for the defendants claim that the case involves an abortion which led to involuntary homicide and that there was no premeditation.
The preliminary hearing has been set for 11 June 2018, following a postponement to allow time for the accused to learn of the charges.
