Government’s legal defense gets Florida court to override MiaCargo lawsuit

Legal advisor to the Presidency, Antoliano Peralta Romero announced the government’s defense was able to get the Federal District Court of South Florida to dismiss on 28 March 2024 the million-dollar lawsuit filed in 2022 by MiaCargo against the Dominican Postal Institute.

MiaCargo had sued the government on 14 June 2022 requesting damages for US$10 million for alleged breach of an exclusivity contract.

The law firm of Squire Patton Boggs, and lawyers Raul B. Mañón and José Ricardo Feris handled the case for the Dominican government.

Peralta said that after almost two years of proceedings, the Florida court accepted the arguments of the Dominican defense and refused to recognize the validity of the alleged contract between MiaCargo and Inposdom, declaring that the then director of the public institution, Adán Peguero, had exceeded his limits in the exercise of his functions and did not have authorization to sign the aforementioned contract.

Through Resolution No. 001-11-021 of the end of 2021, Inposdom had suspended contractual relations with the plaintiff company based on several of the facts found in the ruling.
