PUERTO PLATA.- A company owned by Austrian investors today filed several lawsuits against the Lifestyle Vacation Club for more than US $ 31.7 million for alleged breach of contract for the development of a tourism and resource retention project that should have been reported since 2010 by Sale of timeshare contracts.

The company Esmiralda SRL, through the coordinator of its team of lawyers, Nelson Jáquez Suárez, informed the rupture of its links with the Lifestyle group and claims the retained resources and control of its property "to fully develop the tourism project that Currently it is practically frozen and includes in its first stage 12 villas for vacations and 120 condominium apartments. "

In a meeting with the media, it was explained that in addition to Lifestyle Holidays Assets Holding, the lawsuit includes its subsidiaries Tisha Investments Overseas and Quismar Dominicana. The payment of the retained goods and the termination of the contract is done by the company Esmiralda, which acquired the properties in 2008.

Attorney Jaquez stressed that this kind of contractual breach, among foreign investors, unfortunately affects Puerto Plata as an investment destination and as a time-share offerer; And adds to the set of customer complaints caused by Lifestyle not only in Puerto Plata, but also in other destinations, including worrying complaints that circulate on the Internet and that have been recently reported in our country on social networks.

The coordinator of the defense council of Esmiralda said that it has been necessary to go to the Dominican courts, because the few times in which a rapprochement or a short response via e-mail has been achieved, the Lifestyle Group claims that they have nothing on Which is accountable since they are not promoting or selling the properties.

"This is absolutely false," said Jáquez, and anyone can check it by visiting dozens of Internet sites where the project is advertised, and hundreds of people testify after having acquired real estate under the timeshare in Costa Esmeralda.

Lifestyle Rebuttal

Puerto Plata August 1, 2017 - The Lifestyle hotel consortium rejected the accusations made by the company Esmiralda regarding breach of contract, considering them improper and ill founded.

Speaking on behalf of Lifestyle, the litigation department of the company's Legal Department, Santiago García, informed that by the agreement signed between these companies, the Lifestyle consortium offered the opportunity to beautify some lands that were within the hotel property So that its rejuvenation represents a contribution to the tourist development of the area.

According to the contract, the Lifestyle company would be responsible for the promotion, marketing and operation of the project and, on the matter, has complied, as established in the agreement, with the payments corresponding to the aforementioned commitments.

Regarding the retention of resources through the sale of timeshare contracts, Lifestyle's management reported that the agreement states that Costa Esmeralda's property is not part of the license that allows this type of "Time Share" sales, so operations That he could carry out are strictly under the hotel modality.

The lack of inclusion of the property in the aforementioned license is due to the non-compliance by the company Esmiralda with the requirements for such purposes.

Section 6 of the signed contract states that "Esmiralda will develop in the field of the pre-indicated parcel two tourist projects:" Costa Esmeralda Peninsula "which will consist of eleven (11) Villas and a Master Villa, as well as the Costa project Esmeralda Village which will consist of up to one hundred twenty (120) apartments ". For this reason, says the executive, there is no truth in the version that Lifestyle refused to develop the project because the responsibility for construction of the property falls strictly on the company Esmiralda.

The company Lifestyle also clarified that during the first years of the project it took the initiative to invest of its own resources for the construction of a Model Villa and that the project could start its operations, this because the other part, did not initiate the constructed constructions .

"These accusations are evidently intended to discredit the hotel project that increased contributions have generated not only for the province of Puerto Plata, but also for the entire region," said Santiago Garcia.

The Lifestyle Group in the voice of its legal representative has confirmed that the details concerning the false allegations will be settled in the courts empowered for such purposes.

Trajectory of major agreements

Through its years of operation, the Lifestyle consortium has developed large agreements with renowned companies of great national and international importance in favor of tourism development in the area, among which Grupo Globalia, made up of Air Europa and the chain Of hotels Be Live, Wynn Group of Companies, Alsol Hotels, among many other companies with whom we have achieved great achievements for the sector without any setbacks.

Every time I pass through Cabarete I think how can this town get more congested. By building a huge development on both sides of the road. The project resembles a Cialis boner in a fat man's Spredos. It's too big for its surroundings, it won't go away, and it's impossible to ignore. Even though you try, you can't look away.
AFTER 4 hours call a doctor.

Hahahahahha... you are so funny. Fortunately for the Lifestyle development, most of the tourists coming will not have a car. But I think it will help spur further development along the beach and in the area. I think Cabarete will completely change in five years. We will be complaining about the high price of food in town and on the beach and having to wait in long lines during high season. We will be discussing cheaper alternatives outside of downtown and the way things used to be. We have lived through the good ole times I think and we will look fondly on today. I think things will get a lot more congested in the future.

Could happen if air fare becomes reasonable when using POP airport. Which I doubt will happen.

And I thought that...

Google Translation:

Home » Environment » Lifestyle in Cabarete continues to build without permission
By caba8255 on August 21, 2017.

They are building buildings of 5 floors and 3 floors on the beach without permits and there are no authorities to stop the work.
The Lifestyle project, despite several complaints, continues to work on the beach in Cabarete with the construction of 3-storey buildings, occupying the 60 meters that are public domain and a 5-storey building at the edge of the track.

The tourism ministry, according to one source, has returned the project documents as incomplete. We remember that the tourism ministry has advised that it is not built on the 60 meters of beach and asked for a public view that there was never.

There is no letter of no objection on the part of the municipality of Sosua and Cabarete although the regidores of Cabarete denounced strongly that they are going to stop the work. Those cries were short because these regidores have never been heard. We can assume that they got what they wanted. On behalf of the Cabarete union, Raquel Sierra, you can not expect anything because she does not care about the legality of a project. During his term he was always like that and we are sure that nothing will change. Ilana Newman, a Sosua union, during one of the last sessions of the Sosua Chapter Hall, said that they are still investigating. We do not know how many years it takes to investigate when there is nothing to investigate. There is no letter of no objection from any chapter house that is from Cabarete and Sosua.

The only permit that Lifestyle has is a highly questioned environmental license because it was granted a decree of 1992 in the name of another entity. For us, this decree is not valid because a decree is non-transferable. Note that the 5-story building has no environmental license.

For the old road and its access to the beach, the town hall is supposed to make a boulevard. Raquel Sierra made a small show with a pick on the same road and stayed there. We do not know what the Lifestyle option is for the road and access to the beach because the construction of them is directly at the side of the road. You are hearing that Lifestyle would pay for the beautification of the boulevard but for lack of transparency of the union, you do not know exactly the intentions of those people. So far, it has not been seen that Lifestyle wants to comply with the law. And we can end up an unpleasant end to the community of Cabarete. They can count on the complicity of the authorities.

LIFESTYLE CONTINUES TO BUILD IT WITHOUT PROBLEM BECAUSE NO AUTHORITIES WANT TO INTERVENE. WE HAVE A BUILDING OF 5 FLOORS CONSTRUCTED TO THE RIBBON OF TRACK WITHOUT ANY PERMISSION AND BUILDINGS IN THE BEACH OF 3 FLOORS WITHOUT PERMISSIONS ALSO. ALL THAT PROCESS HAS A CORRUPTION SMELL LIKE IT HAS ALWAYS BEEN THE CASE IN CABARETE.

Hold on a sec.... I saw an article in the local papers the other day that said Francisco Brito at Medio Ambiente and some other govt. agencies had investigated this and said they have all of the correct documentation.

So who's saying Lifestyle has no authority?

It'll be laughable to see the beach side of Lifestyles when the ocean hits its walls, and they're left with no beach for their guests. There's a reason for building 60 meters off.  There's almost no beach on that side of town now and buildings there were built years ago when the beach in front was huge !  Now several hotels have little beach and no beach during parts of the year.

There are at least 3 authorities involved in the permit process. Dominguez Brito took care of providing a permit from his ministry, environment. The other two are the Ministry of Tourism and the local municipal authorities, neither of which have received plans for review. Not that that will lead to a work stoppage.

Not to doubt your input, but how do you know they haven't? Couldn't it have happened with the powers that be in SD and they tell the local officials they've got it covered?

During the last election I learned that all local candidates have a party affiliation with the politicos in SD. If your affiliate wins nationally, you get recognized locally. I suspect that influence is a two way street. When the locals do something not in keeping with the SD party line, I'm sure a call is made to straighten out the wayward local officials.

In the case of lifestyles, due to its size, money and influence, I suspect all that is needed is the support of the SD Club and the locals will be made to heel if they make too much of a fuss.
