I didn't literally mean people are presumed guilty, but there are certain crimes here, and I believe sex with a minor is one of them, where the court can impose preventative custody until trial with no bail or other recourse. It seems every other day I'm reading about someone accused of a crime being put into preventative custody, often for many months until the trial comes up.
Any gringo arrested and charged with a serious crime can expect to be held in preventive custody. I can give many examples of foreigners who were held until trial without bond.

Good morning,
I need help as a tourist.

I'm gay. I met a guy online and we've been chatting for a year.
We eventually decided to meet up last week. I asked him many, many times, before meeting up, how old he was, because I like to be careful.
And to this question, he always replied that he was 19. I have been asking him his cedula as proof of age, he kept telling me that he doesn't have any cédula due to various bureaucratic/paperwork reasons.

so last week on whatsapp I asked him his date of birth just be sure, he replied in writing August 26, 2002.
(On social media, this kid also uploaded a picture with "2002" tattooed on his ankle, so I made the connection and genuinely assumed that he was telling me the truth.)

Then I immediately asked him how old he was, he said (also in writing) "19 años".
He also confirmed this through voice notes (yo soy mayor de edad, etc)

I'm VERY carefully with meeting people here as I'm very aware of the law.
So after this whatsapp exchange, we decided to meet up and have sex (last week).
He asked for some money before this, so I gave him money.

I wasn't planning to meet him ever again after that (to me it was just a "one-night). But then on over the following days, he kept asking to do it again with me, because "necessito dinero".

Because he still didn't have any cedula to show, I refused. He was pissed.

Then next thing I know, last night his mom texts me on whatsapp telling me that she is going to report me to fiscalia because I paid his son for sex, and he is a minor.

I sent her all the screenshots showing how her son repeatedly told me he was 19, with year of birth 2002.
She replied that he is actually 16, not 19.

I had NO IDEA. I feel completely cheated.
She then said that she is a judge and that she will basically have me prosecuted and go to jail.
But then she suggested that, if I want to avoid all this bad stuff, I can make a some sort of deal with her son (not with her though) asap. She didn't specify what kind or deal, but I suspect she wants money.

But for a so called judge to ask me on whatsapp to make a deal with her son, that sounds like she is just blackmailing me and she really isn't a judge.
I mean what kind or judge offers to make a deal BEFORE even reporting the crime?

She said she is going to report me to fiscalia today. Nor sure if this family is just blackmailing and the young fella is really legal of age, or he is really a minor as his mom says.

Also the he now claims himself that he is a minor, saying he doesn't know WHY he lied, but I suspect he did this for money.

Now he claims he needs MORE money to run away from his house to the campo, because supposedly his parents are forcing him to show them where I live, and he doesn't want to oblige. So he needs money to 'escape" to the campo away from his parents.

Please advise on what should I do. If fiscalia really gets on board and the really did lie about his age, I want to be able to defend myself because I GENUINELY and sincerely believed that he was 19.
I have all the evidence in writing.

Also I doubt his mother is a judge - if fact I'd bet on that.
I hope he does not have a photo or your full name on your passport ?

Anyway you are getting a 3rd world education in a hurry.
And like other things with inflation - blackmail is much more expensive than it used to be.
Oh and don't think one payoff will be a one-and-done. That's just a taste of many more they will come at you with.
My bet is the young man has some sexy photos of you as well -
Hope you think it was worth it.

And just as I would bet this kid's mom is not a judge I bet this whole stroy is a DR1 'Honey Trap" - i.e. phony as hell

I think it's very tough to be a gay man in the DR, especially outside of the big cities. A former work colleague and friend, a Scandinavian guy always had a hard time with his relationships with Dominican men. Some turned very violent.

And out in the campo, the old fashioned stigma is still very much alive.

When we baptised our kids, the Catholic father launched into a diatribe about the disgusting behaviour of homosexuality. I told the him that I did not want to indoctrinate my children into an institution that displays such intolerance. The history of the Catholic Church has a very jaded past with respect to abusing minors.

it sounds to me that the kid's mother is exploiting her son. My gut feeling says the kid is not a minor (the tattoo is the clue). The pair of them have embarked on a poorly planned attempt to scam the OP. Move hotels, change your SIM card and enjoy the rest of your stay.

This is precisely the crux of the matter! The OP, like anyone, visiting DR or any other country should, at the very least, do cursory research of the penal code and what is considered acceptable behavior in the visiting country. A brief couple of examples that differ in cultural and legal understanding from say USA are women's attire in a Muslim country and possession of cannabis related products in Russia (please lets not debate these issues here).

The dominican penal code Law 76-02 in Art. 226 establishes coercive measures one of which is preventive prison. Art. 16 limits preventive prison to a reasonable time frame but being a foreigner, and a flight risk, accused of a sex crime with a minor you are almost guaranteed one year in preventive prison. Also of note is there is no trial by jury in the DR.

3 months minimum, 18 months maximum.

There are plenty of gays in every city/town in the DR. At least in public there doesn't seem to be any discrimination against them.
In general most people down here do not care so long as they are not acting like attention seeking drama queens while out in public. Same applies to drug addicts and your local neighborhood drunk however I've never met a Dominican who would be ok with an adult gringo having sex with a poor Dominican child. He would be considered guilty from day one

I can understand why you are panicking, as if the world is about close in on you. Don't panic and try to relax. First of al the are almost certainly trying it on and are not serious with their threats. However in order to feel completely free of this spend the rest of your holiday in another town and block the WhatsApp numbers. You can get nice hotels for around 2000 pesos.

Clearly these guys are out for money nothing more and they would have nothing to gain by going to the police. In fact by doing this it would become clear to everyone in the barrio that the young man is gay and sleeps with older men which wouldn't help his reputation a great deal. So I'm hoping they didn't make a report and I'm hoping the OP managed to leave.

If he lives in a barrio, everyone already knows he's gay. There's no secrets in a barrio!
