Here is just a thought .. again , im not a " restaurant./ bar owner"..
But Logically would it not have taken a lot less money to fix the kitchen , even buy brand new, rather than to give all this money to the Lawyers , plus all the losses accumulating every day that its closed .
imho Rocky has a less than zero chance of
getting the place back + making a profit ...
it does not seem mathematically even possible
so the question begs , what is the end game in such a scenario.
New equipment is expensive. Used here is still spendy, and once again the condition is an unknown.

If the equipment were bad, an experienced restauranteur would have known it the first couple of days after the contract signing at the latest. But how long did the place operate before the foreclosure and equipment issue excuse?

I would bet a years minimum wage there is a clause in the contract where the seller acknowledges the equipment is in acceptable condition. If that clause is missing, Big Frank could sue the lawyer who drew the deal for malpractice. I've bought a LOT of existing businesses that included vehicles and equipment, and that clause is ALWAYS front and center, and the equipment was ALWAYS inspected and approved before closing.

Besides, since a prior long-tenured operating manager went with the sale, that manager had intimate knowledge of the condition of all the equipment and would be essential in determining the state. One would assume he gave an accurate accounting to his boss.

This great guy Rocky had plenty of time to determine the condition of the equipment. It seems the "the equipment is bad" is just an excuse to weasel out of paying the balance in an attempt to recover some portion of a bad investment.

I am still wondering and asking ( not actual $ dollars, cuz not my business) ... but did the #s go UP, or DOWN, when he Renovated and completely changed the place, and colors & most importantly the Whole NAME of the place . and who knows what else.

And for that he only has himself to blame ..not the guy he bought it from.
as a couple people have already said the place was " Turn key"
HE , and HE alone decided to FIX what was clearly not broken..
And if the #s went down (which we are all guessing they did) , the kitchen equipment had NOTHING to do with those #s .. unless he literally could put food out FAST enough.. and customers were walking away..
No one heard any such stories .

So obviously it is complete BS..

An excellent point indeed. One that seems to be fairly glossed over here. It ties in with my previous postings questioning the logic of not changing certain staff members upon turnover of the establishment. Hopefully, the next investor does not make the same impetuous decision.

I find it all quite amusing who certain people on here believe they know it all and only offer their opinion based on friendship. The same contiine to attack someone they don't while making the same assumptions over and over. We get it, Joses o'shea was the greatest beach bar ever, Rockys aqua had no chance ever to survive. It is comical! Let time and the courts figure it out. I hope it works out and the place id opened sooner than later by whomever. Kill me because I enjoyed Rocky's, and it was my favorite spot to hang out on the beach.

Two staples on my list in regards to potential investment opportunities.....

Businesspersons can be charitable, but businesses are not charities.
A chain is only as strong as it's weakest link.

The manager, who in this case was the owner, Big Frank (I was in Norway for 5-months working), should have disclosed something to the buyer about something not working? And in doing so, would have violated the contract agreement which his lawyer drew up?

OK, I see what you mean now.

What you're trying to say is this: The buyer should have fired all of the staff--which many had been there at that point for over 15yrs--and then re-hired people who have little to no training, an unproven track record in honesty, and unproven track record in showing up on time and being responsible?

Is this what you mean?

The new owner should have gotten rid of people who are supporting their children and grandchildren and extended families?

Or, are you saying the previous owner should have fired himself for not reporting the condition of certain things to the new buyer of the restaurant that he is selling?

Frank 12's blog had a running account of the whole renovation. Check it out. It seems like it went on for a month or two. The blog is very detailed about the whole process.

The funny thing here is that the people most vocal in criticizing are the people who never frequented either O'Shay's or Rocky's.

Windeguy (who I like a lot), by his own admission, has admitted to only stepping foot in the place once in the 17yrs that it was open. Once!

I worked there for 11-years, I know who the regular customer are.

Caonoba, who doesn't even know where the place is located, let alone ever visited the place, is suddenly an expert. He seems determined to having all the staff fired to make room for other staff that that we would have absolutely no idea of knowing their previous experience, track record in honesty, math skills, training, and loyalty.

Sky is Big Frank's best friend, so, i know exactly where he is coming from. I understand his agenda, his motivation, etc. Personally, I think it's great, because i like Big Frank a lot as well. But Sky's not being objective here. He's giving one version.

It's great that people have opinions, and i don't care if you are for or against Big Frank or Rocky. I like them both. But there needs to be some balance here. And right now, there is very little.

I admit I did not read the Contract. But we all agree that the Court certainly read the Contract and came squarely down on the side of Big Frank. That is a fact. All the other garbage floated here is just that, GARBAGE.

And the ONLY reason it went OUT of business was because of Global Warming and a few "haters" on social media .
Furthermore, everyone who was NOT a regular Customer needs to just Shut up.. .because its is rude to even discuss WHY a seemingly NICE business in Cabarete just went UNDER.. it is not socially cceptable to speculate on such things, because feelings will get hurt ..
and as we all know feelings are more important than Money ...

A business can not have a part time, seasonal manager and expect to succeed.
Two managers. Day. Night. Both work together, and report directly to the owner. The managers identify problems. The owner corrects problems. The owner if not independent, must answer to investors. Simple enough? If not, prepare yourself for a failed business and lost monies. Especially when it comes to the food and beverage industry. The prevailing words of wisdom that no honest people can be found to work in an establishment on the north coast are disingenuous at best. Most rational people can see beyond the yellow mist being sprayed.

Maybe time to close this thread until there is more confirmed information?

Actually the thread seems to have fulfilled it's named title. The establishment is closed, and will not be opening under it's previous name. A posting further back made reference to a Mexican restaurant......possibly, Pancho Villa's.

Just about every sucker that comes to the DR that ran a successful restaurant in their home country and tried to do the same here went down the tubes, and fast. $20 US for starter dishes does not pan out in Cabarate..............

(Actually once at Jose O'Shays and was overcharged and once when "turned blue" just to see the color inside. Neither version had appeal to me.)

I am critical because the story being told makes no sense. If the place is foreclosed upon, Big Frank owns it. Period.

What good does going to court do at all in such a case? I can only assume the details being discussed are either wrong, the people involved are ignorant to how business is conducted, or there is some lunacy involved or a combination thereof. I have stated before the only people that are going to win by going to the court are the lawyers.
