I just hate seeing investment in that area go bad for whatever reason.

Is one of the parties a US citizen or corporation? If so, jurisdiction could be proper in US federal court....

While it is probably unlikely to happen in this case.......it could....

Lots of Dominican companies and even some agencies of the Dominican government have been sued in Federal Court......remember Sun Land or the myriad of Cap Cana lawsuits.

I really have no idea how this could end up in a meaningful way in a US Federal court despite one person (or even both ) are US citizens when the deal is done in the DR. Of course anyone can start a lawsuit against almost any other person or company in the US, and that is a problem with the US legal system. Under what circumstances does a US court have jurisdiction on what happens in the DR?

Let's say there was a legal basis for a lawsuit in the US courts and it was won in the US, how could it be enforced in the DR?

Really unsure why of all the Rocky bashing maybe I am just taking it the wrong way. Frank12 even stated he was a good guy. I never had the pleasure of going to Jose O'sheas or meeting Big Frank. So I can't comment on that end of the subject. Personally I really enjoyed hanging out at Rocky's Aqua. I liked the cast of characters that would be there. It was laid back and friendly. The staff was fun and excellent. They made you feel at home. The food was good especially compared to other places on the beach. Rocky was a good guy whenever I met him. The Superbowl party was great. I don't understand why bashing someone for changing what the place use to look like. Things change, I get the feeling if he left it as is people would be bashing him over that. I just hope it gets resolved and opens back up. I hope that for the staff more than anything regardless of who owns it, what it looks like or whatever it will be called. I look forward to enjoying another Superbowl party on the beach there in 2019.

I have nothing at all to say against Rocky. Not a thing. I hoped Rocky would be successful in a location that I entered once and never entered again while run by the previous owner.

It is the circumstances of the deal that are in question. Going to the courts will be painful and only the lawyers will win.

I would assume experienced business people would put venue for conflict resolution in their contract.

What everyone here seems to not know is that this did go to Court. It took about two years for this decision to be handed down. Rocky lost for non payment of the contract and the lien by Frank on the property is now upheld. So all this talk of lawyers and a long court case is nonsense. Sure he could try and get this overturned, but good luck with that.

And one more thing. I am sure that Frank 12 can attest to the fact that when Big Frank made a deal, whether in writing or on a simple handshake he honored that deal. I know because I have had deals with him. Sorry I can't say the same for the other guy here.

So If Rocky was running this bar for 2 years without actually ever making the full payment for it ...

It is or should be standard boilerplate language in any contract between contracting parties. The bond holders of Cap Cana had governing law of the state of New York in their contract.

But what of those individuals who have no contract and come as tourists and are assaulted or injured while in the DR.....they generally file suit against a Dominican entity or individual in their home country. And it works the other way as well.......Dominicans suing in federal court against a US entity.

With literally millions of tourists.....it happens more than you might think.

How did that work out for the parties involved?

Now that we know that courts have already made a decision and the assets were seized on the behalf of Big Frank, we can only see if he or a new owner will do anything with the structure.

Hopefully it will be a place that frequently has live music. :cheeky:

More importantly at this point is, Training camp has begun for the NFL, Where the hell am I to watch my games this fall and winter?? Frank12???

That's my concern as well...where and the hell am i going to watch football????

Matt Damon’s place in Sosua is my preferred location now. On Dr Rosen, across from MetroBus/ Texaco.

Just wanted to add...

I miss Marco

I think he wants to open a non -alcohol vegetarian Restaurant, but he is not sure.

And Rocky (from CT) can buy a place on Dr Rosen just a few doors down from the Pedro Clistante intersection and rent some rooms as well based upon the desires of some posters to go back in time.
